Privacy Policy

1. Who we are

Niyog AI is currently operated as a pre-incorporation Indian sole proprietorship; the company entity (Niyog AI Pvt Ltd) is targeted for registration in June 2026. References to "we", "us", or "our" in this policy refer to the operator of Niyog AI. Our contact email is hello@niyogai.com. After incorporation, this policy will be updated with the registered entity name and CIN; rights and obligations under it remain unchanged.

2. Information we collect

When you use Niyog AI, we collect the following types of information:

  • Contact information: Name, phone number, email address provided when signing up, booking a demo, or contacting us.
  • Business information: Company name, city, lead volumes, and other details you provide to configure your agents.
  • Usage data: How you interact with the platform, agent activity logs, message counts, and feature usage.
  • Lead data: Information about your leads processed by Niyog AI agents — name, phone, budget, message, and lead source.
  • Payment data: We do not store card details. Payments are processed by Razorpay, which has its own privacy policy.
  • WhatsApp messages: Conversation logs between Alex and your leads, stored to power follow-up sequences and reports.

3. How we use your information

  • To provide and operate the Niyog AI platform
  • To send scheduled WhatsApp messages on your behalf to your leads
  • To generate business reports and analytics for your account
  • To send you service-related notifications (billing, downtime, updates)
  • To improve our AI models and agent performance
  • To comply with legal obligations

We do not sell your data. We do not use your lead data for advertising.

3a. Lawful basis for processing

Under the Digital Personal Data Protection Act, 2023 (DPDP Act) Section 6 and, where you are located in the EU/UK, the General Data Protection Regulation (GDPR) Article 6, we rely on the following lawful bases:

  • Contract performance (DPDP §7(a) / GDPR Art. 6(1)(b)) — to operate the Service you subscribed to, send messages on your behalf, generate invoices, and provide support.
  • Consent (DPDP §6 / GDPR Art. 6(1)(a)) — for optional analytics, marketing communications you opt into, and any non-essential cookies. You may withdraw consent at any time without affecting Service delivery.
  • Legitimate interest (GDPR Art. 6(1)(f)) — to secure the platform, prevent fraud, and improve product quality. We balance this against your rights and offer opt-outs where appropriate.
  • Legal obligation (DPDP §7(g) / GDPR Art. 6(1)(c)) — to comply with tax, anti-money-laundering, and lawful enforcement requests.

4. Data storage and security

All data is stored on servers located within India. We use industry-standard encryption (TLS 1.3 in transit, AES-256 at rest). Access to customer data is restricted to authorised Niyog AI team members only.

5. WhatsApp and Meta

We use the official WhatsApp Business API through an approved Business Solution Provider. Message templates sent to your leads are reviewed by Meta before activation. We comply with WhatsApp's Business Policy and Commerce Policy. Your leads' WhatsApp data is subject to Meta's Privacy Policy in addition to ours.

6. Data retention & deletion

We retain your account data for the duration of your subscription plus 30 days after cancellation, after which it is permanently deleted. You can request earlier deletion by emailing hello@niyogai.com or via our Data Deletion page — full instructions, channels, and timelines are documented there.

7. Your rights

Under the Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable Indian law, you have the right to:

  • Access the personal data we hold about you
  • Request correction of inaccurate data
  • Request deletion of your data (subject to legal obligations)
  • Withdraw consent for data processing

8. Cookies

Our website uses essential cookies for session management and analytics cookies (via a privacy-respecting analytics provider). No tracking cookies are used for advertising.

9. Third-party services

We use the following third-party services that may process your data:

  • Anthropic (Claude AI — for powering Alex conversations)
  • OpenAI (image generation for marketing posts only — no customer data)
  • Meta / WhatsApp Business API
  • Razorpay (INR payment processing)
  • Stripe (non-INR payment processing)
  • Sentry (error monitoring — no customer payload, only stack traces)
  • Vercel (website hosting)
  • n8n (workflow engine, self-hosted in India)

10. Grievance Officer (DPDP Act 2023)

Per Section 8(9) of the Digital Personal Data Protection Act 2023, our designated grievance officer for data-related complaints is:

11. Changes to this policy

We may update this policy from time to time. Material changes will be communicated via email or WhatsApp to active subscribers at least 7 days before taking effect.
